Effective Date: September 28, 2026

Welcome to ColdRiverElectric.com. These Terms and Conditions govern your use of this website, including information, contact forms, communications and other features made available through the site.

By accessing or using this website, you agree to these Terms and Conditions. If you do not agree with these Terms, please do not use the website.

About Cold River Electric

Cold River Electric is the trade name under which Scott Underwood, a licensed electrician based in Wilmington, Vermont, does business. Cold River Electric is not represented on this website as a separate corporation, limited liability company or other separate legal entity.

Scott Underwood is a licensed electrician serving customers in Vermont, Massachusetts and New Hampshire, subject to the licensing, business name, permitting, inspection and other requirements applicable in each state.

The manner in which electrical services are offered, contracted and invoiced may vary by state as required by applicable law.

Website Information

The information provided on this website is intended for general informational and marketing purposes only.

Nothing on this website constitutes electrical, engineering, building code, safety or other professional advice concerning a particular property or electrical condition.

Electrical systems can present serious risks of shock, fire, injury and property damage. Information appearing on this website should never be used as a substitute for an inspection or evaluation by a properly qualified professional.

If you believe an electrical condition creates an immediate danger, do not rely on this website or its contact form. Contact the appropriate emergency service, utility provider or qualified professional.

Website Inquiries Do Not Create a Contract

Submitting a contact form, sending an email, requesting an estimate, requesting information or otherwise communicating through this website does not create a contract and does not obligate Scott Underwood or Cold River Electric to perform any work.

A project is accepted only when the appropriate parties agree to the project terms through a proposal, estimate, work authorization, contract or other applicable written agreement.

Projects may be accepted or declined based on location, scope, scheduling, licensing requirements, permitting requirements, safety considerations, availability or other legitimate business considerations.

Estimates, Pricing and Project Information

Any pricing, service descriptions, project examples or general information appearing on this website are informational only unless expressly incorporated into a written project agreement.

Actual pricing may depend on site conditions, accessibility, existing electrical systems, materials, labor, permitting, inspections, code requirements, utility requirements, concealed conditions and the final agreed scope of work.

A project specific written estimate, proposal, work order or contract will control over general information appearing on this website.

Unless expressly stated in writing, website communications do not constitute a guaranteed price, start date, completion date or commitment to perform work.

Project Agreements Control

Electrical work may be governed by a separate written proposal, work order, contract, change order or other project agreement.

Project agreements may address matters including the scope of work, materials, pricing, payment, deposits, scheduling, access to the property, permits, inspections, concealed conditions, customer requested changes, warranties and dispute procedures.

If a project agreement conflicts with these website Terms and Conditions, the project agreement will control with respect to that project, subject to applicable law.

These website Terms are not intended to replace any contract language, disclosure, notice, cancellation right, consumer protection or other requirement imposed by Vermont, Massachusetts, New Hampshire, federal law or applicable local law.

Permits, Codes and Inspections

Electrical work will be performed subject to applicable electrical codes, licensing requirements, permitting requirements, inspections and utility requirements.

Permit and inspection requirements vary depending upon the jurisdiction and type of work being performed.

Nothing on this website should be interpreted as a determination that a particular project does or does not require a permit, inspection, utility approval or other governmental authorization.

Customer Provided Information

Customers requesting an estimate or discussing a potential project are responsible for providing information that is accurate to the best of their knowledge.

Preliminary recommendations, estimates and scheduling decisions may depend upon information supplied by the customer.

Conditions that are concealed, inaccessible, incorrectly described or not reasonably discoverable before work begins may affect the scope, price or schedule of the project and may require additional authorization or a change to the project agreement.

Vermont Projects

Electrical services performed in Vermont are subject to Vermont electrical licensing, electrical safety, permitting, inspection and code requirements.

Scott Underwood performs electrical work under his applicable Vermont electrical license.

Vermont generally exempts tradespeople licensed, registered or certified by the Department of Public Safety from separate residential contractor registration when they are working within the scope of that professional license.

If a particular project includes work outside the scope of licensed electrical services, additional contractual, registration or regulatory requirements may apply.

Nothing in these Terms limits any right or obligation imposed by Vermont law.

Massachusetts Projects

Electrical services performed in Massachusetts are subject to applicable Massachusetts electrical licensing, permitting, inspection and code requirements.

Scott Underwood, doing business as Cold River Electric, performs electrical work in Massachusetts under his applicable Massachusetts electrical license.

Massachusetts law permits licensed electricians working exclusively within the scope of their licensed electrical profession to operate under rules applicable to that licensed profession rather than the Massachusetts Home Improvement Contractor registration program.

If Scott Underwood is asked to undertake work outside the scope of licensed electrical services, additional licensing, registration, contracting or other requirements may apply.

Nothing in these Terms limits or waives any consumer right or other protection provided by Massachusetts law.

New Hampshire Projects

Electrical services performed in New Hampshire are subject to applicable New Hampshire electrical licensing, permitting, inspection and code requirements.

Scott Underwood performs electrical work in New Hampshire under his applicable New Hampshire electrical license.

Certain contracts involving construction, remodeling or improvement of a New Hampshire residence may be subject to the notice and opportunity to repair requirements contained in New Hampshire RSA Chapter 359 G.

When required by law, the applicable project contract will contain the required New Hampshire notice concerning construction defect claims and the homeowner's obligation to provide notice before commencing certain legal proceedings.

Nothing in these Terms limits any right or obligation provided by New Hampshire law.

Photographs, Renderings and Illustrative Images

Photographs and images on this website may include actual project photographs, illustrative images, digital renderings or artificially generated imagery.

Images are intended to communicate the types of work, environments, services or design aesthetic associated with the website and should not be interpreted as a guarantee that a particular project, fixture, material or finished result will be identical to an image shown.

Actual Cold River Electric projects will be identified as such where appropriate.

Intellectual Property

Unless otherwise stated, the Cold River Electric name, logo, branding, website design, written content, graphics and other original website materials are owned by, licensed to or used with permission by Scott Underwood.

Website materials may be viewed for ordinary personal or informational purposes.

No website content or branding may be copied, reproduced, republished, sold, distributed, modified or commercially exploited without permission, except as otherwise permitted by law.

Third Party Websites and Services

This website may contain links to third party websites or services, including mapping services, manufacturers, suppliers, social media platforms or other outside resources.

Those websites and services are independently operated.

Scott Underwood and Cold River Electric are not responsible for the content, availability, security, accuracy or privacy practices of third party websites.

Privacy

Information submitted through this website will be handled in accordance with the Cold River Electric Privacy Policy.

Users should review the Privacy Policy for additional information regarding information collected through website inquiries and other website features.

Website Availability and Accuracy

Reasonable efforts are made to maintain accurate and current information on this website.

The website may nevertheless contain typographical errors, outdated information, technical problems or interruptions.

Continuous, uninterrupted or error free access to the website is not guaranteed.

Prohibited Use

This website may not be used to interfere with its operation, gain unauthorized access to systems or information, distribute malicious software, impersonate another person, submit fraudulent information, violate intellectual property rights or engage in unlawful conduct.

Access may be restricted when reasonably necessary to protect the website, its owner or other users.

Website Disclaimer

This website and its general informational content are provided on an "as available" basis.

No representation is made that general website information is suitable for every property, project, electrical system or condition.

This disclaimer concerns use of the website and its informational content. It does not eliminate or reduce obligations arising from electrical work actually performed, an applicable project agreement or rights provided by law.

Limitation of Liability for Website Use

To the fullest extent permitted by applicable law, Scott Underwood and Cold River Electric will not be responsible for indirect, incidental, special or consequential damages arising solely from the use of, inability to use or reliance upon general information contained on this website.

This limitation applies to website use and website information.

It does not disclaim responsibility for electrical work actually performed, obligations contained in an applicable project agreement, negligence, gross negligence, willful misconduct, statutory obligations or any liability that applicable law does not permit to be waived or limited.

Limited Indemnification

To the extent permitted by law, a person who unlawfully misuses this website agrees to be responsible for claims, losses or reasonable expenses resulting directly from that person's unlawful conduct, violation of these Terms or infringement of another person's rights.

This provision does not require a customer to indemnify Scott Underwood or Cold River Electric for negligence, defective work, breach of a project agreement or obligations imposed upon Scott Underwood by law.

Consumer Rights

Nothing in these Terms is intended to waive, restrict or avoid a consumer protection, warranty, remedy, statutory right or other protection that applicable law does not permit a consumer to waive.

If a provision of these Terms conflicts with a mandatory consumer protection law, the applicable law will control.

Governing Law for Electrical Projects

The law applicable to an electrical project will generally depend upon the state in which the property and work are located.

Vermont projects will be subject to applicable Vermont law.

Massachusetts projects will be subject to applicable Massachusetts law.

New Hampshire projects will be subject to applicable New Hampshire law.

Any project agreement may contain additional lawful provisions concerning dispute resolution, governing law or venue, but nothing in these website Terms requires a homeowner or consumer to surrender a right concerning jurisdiction or venue that applicable law does not permit to be waived.

Governing Law for Website Use

Issues arising solely from the use of ColdRiverElectric.com, as distinguished from electrical contracting services, will be governed by Vermont law to the extent Vermont law may lawfully apply.

Nothing in this provision requires a consumer to bring a claim in Vermont when the law applicable to that consumer or dispute provides otherwise.

These website Terms do not determine the governing law or venue for electrical work performed in another state.

No Waiver

A failure to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or any other provision.

Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be limited or removed to the extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

Changes to These Terms

These Terms may be updated periodically to reflect changes in the website, business practices or applicable law.

The current version will be posted on this page with an updated effective date.

Changes to website Terms will not retroactively alter an existing signed project agreement unless the parties separately agree in writing.
